The relatives of the Malaysian aircraft that was destroyed in Ukrainian airspace intend to submit a lawsuit against the Ukrainian administration. Thomas Schansman, the father of one of the victims, stated in an interview to the German RTL channel on May 11, according to the “Komsomolskaya Pravda” online newspaper.
The reason for the suit is Ukraine’s failure to close its airspace to civil aviation despite the hazardous situation.
A lawyer acting on behalf of several relatives of the crash victims have submitted a lawsuit to the European Court of Human Rights. The total claim against Ukraine can amount up to 300 million euros.
The Malaysia Airlines flight crashed on July 17, 2014, near Donetsk. The Boeing-777 was performing flight MH17 from Amsterdam to Kuala Lumpur. Citizens of 10 states were killed: 298 people, including 283 passengers and 15 crew members. The preliminary report of the international commission of inquiry of September 28, 2016, states that the aircraft was downed by a 9M38 missile launched from a “Buk” surface-to-air missile system from the territory under militia control. 17 “Buk-M1” surface-to-air missile systems operated by the Ukrainian army were in the east during the crash, according to the Russian Foreign Ministry statement on March, 2017.
