MH17 crash attorneys propose two main versions of events

Ukraine could have intentionally left the sky over Donbass open in order to use civilian aircraft as a human shield, said Sabine ten Dusschate, the attorney for one of those accused on the case of the Malaysian Boeing catastrophe (flight MH17) during a court hearing in the Netherlands on June 23.

The lawyer noted that the defense put forward several main versions of the Malaysian Boeing crash. First, the plane could have been shot down by the Ukrainian military by mistake, because the Armed Forces of Ukraine had to access to Buk air defense missile systems.

Moreover, the defense notes that there is another version of events. In particular, the Ukrainian authorities may have deliberately left the sky over Donbass open to civilian aircraft, using them as human shields. According to lawyers, at the same time  a Ukrainian military plane could has been in the skies together with the passenger liner.

In such a case, even if the Donbass rebels had fired a shot, accidentally hitting a passenger plane, their actions should be qualified as self-defense.

MH17 hearings resumed in the Netherlands on Monday, on June 8. Malaysian Boeing, flying from Amsterdam to Kuala Lumpur by flight MH17, crashed on July 17, 2014 near Donetsk. Onboard there were 298 people, all of them died.
